GENERAL TERMS AND CONDITIONS OF SALE 

1. Purpose

These general terms and conditions of sale (hereinafter, the "T&Cs") apply without restriction or reservation to all online sales offered by the company PROPULSION CONSULTING, a simplified joint-stock company (société par actions simplifiée) with a capital of 2,500 euros, whose registered office is located at 402 route de la Tour d’Aigues – 84240 Grambois, registered with the Avignon Trade and Companies Register under number 938 760 998 (hereinafter, the "Seller" or "European Drones Shop – EDS"), on the website https://europeandroneshophobbywinguav.com (hereinafter, the "Site").

The Seller may be contacted at the following coordinates, notably for any complaints :

The Site constitutes an e-commerce platform allowing consumers, acting for personal purposes (hereinafter, the "Buyers"), to order drones (consumer and professional), electronic components, batteries (LiPo, Li-ion), UAV accessories, spare parts, and associated equipment (hereinafter, the "Products").

These T&Cs define the terms of sale, payment, delivery, as well as the respective rights and obligations of the parties regarding the online sale of Products. They are accessible at any time on the Site and prevail over any other version or contradictory document. The applicable version is the one in force on the date of the Buyer's order.

2. Application of the T&Cs

These T&Cs apply to all sales concluded by the Seller with Buyers. They prevail over any other general or specific conditions not expressly accepted by the Seller. The Seller reserves the right to supplement these T&Cs with special conditions applicable to certain products or services. In case of contradiction, the special conditions shall prevail.

The failure of the Seller to invoke any provision of these T&Cs at a given time shall not be interpreted as a waiver of the right to invoke it later. If any clause is declared null or unenforceable, the other provisions shall remain in full force.

3. Legal Capacity – Acceptance – Account – Site – Products

3.1 Legal Capacity

The Site is accessible to any natural person with the legal capacity to contract under applicable law.

3.2 Acceptance

Acceptance of these T&Cs is materialized by a checkbox during order validation. This acceptance is full and entire; any conditional acceptance is considered null and void.

3.3 Account Creation

Placing an order does not require account creation. However, a Buyer may create one by providing accurate information. The Buyer is solely responsible for this information.

3.4 Account Security

The Buyer is responsible for the confidentiality of their credentials. The Seller must be notified immediately of any fraudulent use.

3.5 Site Accessibility

The Site is accessible 24/7, except for maintenance or force majeure. The Seller is not liable for interruptions or bugs.

3.6 Product Characteristics

Essential characteristics are presented on the Site. Photographs and descriptions are indicative and not contractual. Products are offered subject to availability.

4. Orders (B2C – Consumers)

4.1 Placing an Order

To place an order, the Buyer selects the Product(s) of their choice and adds them to their shopping cart. They then confirm their shopping cart after reviewing its contents, entering their shipping and billing information, and selecting their shipping method and payment method. Before final confirmation, the Buyer has the opportunity to review the details of their order and correct any errors. Confirmation of the order constitutes full and unconditional acceptance of these Terms and Conditions.

4.2 Order Confirmation

Once the order has been confirmed, the Buyer will receive a confirmation email summarizing the details of the order. The Buyer must verify the accuracy of the information provided and ensure they are able to receive this email. The Seller recommends that the Buyer save this email as proof of the order.

4.3 Confirmation and Formation of the Contract

The sale is deemed concluded upon confirmation of the order by the Seller. The Seller reserves the right to refuse or cancel any order for legitimate reasons, including in the event of : suspected fraud, payment irregularities, incomplete or incorrect information, or a prior dispute with the Buyer

4.4 Product Unavailability

Products are offered while supplies last. In the event of unavailability after the order is placed, the Seller will notify the Buyer as soon as possible. The Buyer may then choose between: a refund or an equivalent replacement product. The refund will be issued within a maximum of 14 days.

4.5 Order Modification or Cancellation

All confirmed orders are firm and final. However, the Buyer may exercise their right of withdrawal under the conditions set forth in the relevant section. Any request for modification or cancellation prior to shipment remains subject to the Seller’s approval.

5. Right of Withdrawal

5.1 General Principle

In accordance with the provisions of the Consumer Code, the consumer Buyer has a period of fourteen (14) days from the day following receipt of the Product(s) to exercise their right of withdrawal, without having to provide a reason for their decision or incur any costs other than those provided for by law. For an order consisting of multiple Products delivered separately, the period begins on the day following receipt of the last Product.

5.2 Exercising the right of withdrawal

To exercise their right of withdrawal, the Buyer must notify the Seller, before the expiration of the aforementioned period, of their decision to withdraw by means of :

  • Either the standard withdrawal form attached to these Terms and Conditions,
  • Either any unambiguous statement expressing their intention to withdraw.

Simply returning the Product or refusing to accept delivery is not sufficient to validly express the intention to withdraw.

5.3 Return of Products

The Buyer must return the Products to the Seller without undue delay and, at the latest, within fourteen (14) days of notifying the Seller of their decision to withdraw.

The Products must be returned in a condition that allows them to be resold. The Buyer may be held liable for any depreciation of the Product resulting from handling other than that necessary to establish the nature, characteristics, and proper functioning of the Product.

Unless otherwise specified by the Seller, the direct costs of returning the Products shall be borne by the Buyer.

5.4 Refund

In the event of a valid exercise of the right of withdrawal, the Seller shall refund to the Buyer all amounts paid, including the standard delivery costs initially charged, without undue delay and no later than fourteen (14) days from the date on which the Seller is informed of the Buyer’s decision to withdraw.

The Seller may, however, defer the refund until the Products have been returned or until the Buyer has provided proof of shipment of such Products, whichever occurs first.

The refund will be made using the same payment method used for the order, unless the Buyer expressly agrees to another method and provided that no additional costs are charged to the Buyer.

5.5 Exceptions

In accordance with applicable law, the right of withdrawal may not be exercised for Products made to the Buyer’s specifications or that are clearly personalized, nor in other cases provided for by law.

6. Prices and Payment Terms (B2C)

6.1 Prices

The prices of the Products displayed on the Site are listed in euros, inclusive of all taxes (TTC), excluding shipping costs, unless otherwise stated. The shipping costs applicable to the order are specified before the order is finalized. The Seller reserves the right to modify its prices at any time.

However, Products are invoiced based on the rates in effect at the time the Buyer confirms the order.

For orders delivered outside the European Union, customs duties, local taxes, import duties, or other fees that may be required by the authorities of the destination country may be due. These fees remain the sole responsibility of the Buyer.

6.2 Payment Due Date

The price is due in full at the time the order is placed.

The order will not be processed until full payment has been received.

6.3 Payment Methods

Payment is made online using any method offered on the Site at the time of ordering, via a secure payment provider. The Buyer warrants to the Seller that they have the necessary authorization to use the selected payment method.

6.4 Payment Issues or Refusal

The Seller reserves the right to suspend, refuse, or cancel any order in the event of :

  • Refusal of payment authorization by the relevant authorities,
  • Non-payment or partial payment,
  • Fraudulent use or suspected fraudulent use of a payment method,
  • An existing dispute with the Buyer regarding payment for a previous order.

In such a case, the Seller shall not be held liable.

6.5 Invoicing

An invoice is issued and sent to the Buyer by any appropriate means, including email.

7. Delivery

7.1 Delivery Area

Buyers are expressly informed that the Seller offers delivery of the Products only to the geographic areas indicated on the Website at the time of the order.

7.2 Delivery Terms

Products are delivered to the address provided by the Buyer at the time of ordering as the shipping address (which may differ from the billing address). Several delivery methods may be offered, depending in particular on the nature of the Products, their weight, and their destination. Before confirming the order, the Buyer is informed of the available delivery methods as well as the corresponding delivery times and fees. The Buyer is required to select the desired delivery method and provide all information necessary for the proper execution of the delivery. The Buyer is solely responsible for the accuracy of the information provided.

The Buyer agrees to notify the Seller as soon as possible of any changes to their contact information.In the event of an error or omission in the information provided, resulting in an inability to deliver or a return of the package, the costs of reshipping may be billed to the Buyer.

7.3 Delivery Times

The delivery times indicated at the time of ordering are provided for informational purposes only.

In accordance with applicable regulations, the Seller agrees to deliver the Products within a maximum of thirty (30) days from the date the order is confirmed, unless otherwise notified to the Buyer prior to confirmation.

In the event of a delivery delay, the Buyer may give the Seller formal notice to make the delivery within a reasonable additional period. If delivery is not made within this period, the Buyer may cancel the order under the conditions provided by law. The Seller shall not be held liable for any delay attributable to the Buyer, the carrier, or a force majeure event.

7.4 Receipt of Products

The Buyer is required to inspect the condition of the Products upon receipt.

In the event of any apparent defect (damaged or opened package, missing or damaged product), the Buyer is requested to :

  • file specific and detailed objections with the carrier at the time of delivery
  • notify the Seller as soon as possible

These checks facilitate the processing of any potential claims.

7.5 Transfer of Risk

The risk of loss or damage to the Products is transferred to the Buyer at the moment the Buyer, or a third party designated by the Buyer, takes physical possession of the Products.

7.6 International Delivery

International delivery is subject to these Terms and Conditions.

The Seller handles the necessary shipping formalities. However, the Buyer is solely responsible for ensuring the Products comply with import regulations in the destination country.

Customs duties, local taxes, or import fees may be required by the authorities of the destination country. These costs are the sole responsibility of the Buyer.

The Seller shall not be held liable in the event of customs delays, import refusals, or specific regulations applicable in the destination country.

8. Warranties – Customer Service – Returns

8.1 Legal Warranties

In accordance with applicable legal provisions, the Buyer is entitled to :

  • The legal warranty of conformity (Articles L.217-3 et seq. of the Consumer Code)
  • The warranty against hidden defects (Articles 1641 et seq. of the Civil Code)

In this context, the Buyer may request repair or replacement of the defective Product, or failing that, a refund, under the conditions provided by law.

8.2 Enforcement of Warranties

In the event of a defect or non-conformity, the Buyer must contact the Seller’s customer service department as soon as possible, providing:

  • The order number
  • A detailed description of the problem
  • Any supporting evidence (photographs, videos, etc.)

The Seller may request the return of the Product in order to conduct an inspection.

8.3 Return Conditions

Any return of a Product must be approved in advance by the Seller. The Product must be returned in suitable packaging that allows for transport without damage, accompanied by items enabling its identification (order number, invoice, etc.) Return shipping costs are the responsibility of the Buyer, except in cases of proven defects covered by statutory warranties.

8.4 Warranty Exclusions

The following are not covered by the warranties:

  • Normal wear and tear of the Product
  • Damage resulting from misuse, negligence, or lack of maintenance
  • Any unauthorized modification or intervention on the Product
  • Use that does not comply with the manufacturer’s recommendations

8.5 Technical Products – Drones

The Products sold are technical devices whose use is subject to specific regulations (notably DGAC, EASA).

The Buyer is solely responsible for :

  • Compliance with applicable regulations
  • Obtaining the necessary authorizations
  • Proper use of the Products

The Seller shall not be held liable for improper or illegal use.

8.6 Lithium Batteries (LiPo / Li-ion)

Lithium batteries are sensitive products requiring strict precautions for use.

The Buyer agrees to :

  • Use appropriate charging equipment
  • Adhere to charging and discharging voltages
  • Never charge unattended
  • Store batteries in secure conditions

The Buyer is informed that any misuse may result in :

  • product damage
  • overheating
  • fire or explosion

Any non-compliant use is the sole responsibility of the Buyer and voids the warranty.

8.7 Seller’s Decision

After inspecting the returned Product :

  • If the defect is confirmed → repair, replacement, or refund
  • If no defect is found → the Product may be returned to the Buyer at the Buyer’s expense

9. Liability

9.1 General Principle

The Seller is automatically liable to the Buyer for the proper performance of the obligations arising from the distance contract.

However, the Seller shall not be held liable where the non-performance or improper performance of the contract is attributable to :

  • The Buyer
  • An unforeseeable and insurmountable act by a third party
  • A force majeure event

9.2 Limitation of Liability

The Seller shall not be held liable for damages resulting from :

  • Improper use of the Products
  • Failure to follow the instructions for use
  • Modification or tampering with the Product
  • Negligence or fault on the part of the Buyer

The Seller shall not be liable for indirect damages, including but not limited to :

  • Loss of business
  • Loss of data
  • Loss of revenue
  • Commercial loss

9.3 Technical Products

The Products offered are technical equipment, particularly in the field of drones and electronic systems.

The Buyer is solely responsible for :

  • The installation of the Products
  • Their configuration
  • Their use

The Seller shall not be held liable for any consequences resulting from misuse or improper use.

9.4 Use of Drones

The use of drones is subject to specific regulations.

The Buyer is solely responsible for :

  • Compliance with applicable regulations (DGAC, EASA, etc.)
  • Obtaining the necessary authorizations
  • Operating conditions

The Seller shall not be held liable for any damage resulting from improper or illegal use of the Products.

9.5 Lithium Batteries

Lithium batteries pose specific risks.

The Seller shall not be held liable for any damage resulting from :

  • Improper use
  • Failure to comply with charging or storage conditions
  • Use of unsuitable equipment

9.6 Financial Limitation

In any event, the Seller’s liability shall not exceed the amount actually paid by the Buyer for the Product in question.

9.7 Force Majeure

The Seller shall not be held liable in the event of non-performance or delay resulting from a force majeure event, including :

  • Natural disasters
  • Fires
  • Strikes
  • Transportation disruptions
  • Logistical or customs delays
  • Communication network failures

10. Intellectual Property

The systems, software, structures, infrastructure, databases, and content of any kind (text, images, visuals, music, logos, trademarks, databases, etc.) operated by “EDS” on the Site are protected by all applicable intellectual property rights or database producer rights. Any disassembly, decompilation, decryption, extraction, reuse, copying, and more generally, any acts of reproduction, representation, distribution, and use of any of these elements, in whole or in part, without the authorization of “EDS” are strictly prohibited and may result in legal action.

11. Unsubscription

The Buyer may unsubscribe from the Site at any time by sending a request to that effect to “EDS” via email, using the contact information provided in Article 1.

Unsubscription takes effect within a maximum of seven (7) days from the date of this request. It results in the automatic deletion of the Buyer’s Account.

12. Processing of Personal Data

The Buyer is informed that the processing of their personal data is governed by the privacy policy available here https://europeandroneshop.com/content/8-privacy-policy.

16. Language

In the event that these Terms and Conditions are translated into one or more languages, the French language shall prevail in the event of any contradiction or dispute regarding the meaning of a term or provision.

17. Governing Law and Disputes

These Terms and Conditions are governed by French law.

In the event of a dispute, the consumer Buyer may bring the matter before:

  • Either the court of their place of residence
  • Or the court of the place of delivery

18. Mediation

In accordance with the provisions of the Consumer Code, the Buyer has the right to seek the assistance of a consumer mediator, free of charge, for the amicable resolution of any dispute with the Seller.

To this end, the Seller guarantees the Buyer effective access to a consumer mediation service. The Buyer may, in particular, refer the matter to the following mediator:

Before referring the matter to the mediator, the Buyer must have submitted a written complaint to the Seller.

19. Electronic Evidence

Computer records stored in the Seller’s systems, under reasonable security conditions, shall be considered proof of communications, orders, and payments between the parties.

20. Final Provision

If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

The Seller’s failure to enforce a provision at any given time shall not constitute a waiver of the right to enforce it at a later time.
